با سلام امیدوارم حالت خوب باشد

 «شیوا نظرآهاری مستحق زندان نیست»

شیوا نظرآهاری فعال حقوق کودکان و عضو کمیته گزارشگران حقوق بشر، از آذرماه سال گذشته در زندان به سر می‌برد.

وکیل او اعلام کرده که حکم محاربه به وی تفهیم شده. فعالان حقوق بشر نگران صدور حکم سنگین برای او هستند

شیوا نظرآهاری فعال ۲۷ ساله‌‌‌ی حقوق بشر، نهمین ماه زندانش را می‌گذراند. وکیل او محمد شریف در گفت و گو بارسانه‌‌ها اعلام کرده که اتهام محاربه به موکلش تفهیم شده. آقای شریف پس از اعلام حکم بدرالسادات مفیدی موکل دیگرش اعلام کرد که نگران شیوا نظرآهاری است.

 دستگیری در سال ۱۳۸۸

وی مجددا در جریان نا آرامی‌های مربوط به اعتراضات به نتیجه انتخابات دهمین دوره ریاست جمهوری ایران، حوالی ساعت ۱۳:۳۰ روز یک شنبه، ۲۴ خرداد ماه ۱۳۸۸، توسط نیروهای اطلاعاتی در محل کار خود بازداشت شد.منزلش تفتیش شده‌است و نیروهای امنیتی وسایل شخصی وی را با خود برده‌اند

شادی صدر وکیل مدافع وی نیز صبح جمعه ۲۶ تیر ۱۳۸۸ در حالیکه از بلوار کشاورز قصد رفتن به نماز جمعه ۲۶ تیرماه ۱۳۸۸ را داشت توسط نیروهای لباس شخصی، با خشونت و بدون حکم قضائی سوار اتومبیلی شد و به مکان نامشخصی انتقال داده شد.

روز سه شنبه، ششم مرداد ماه ۱۳۸۸، شیوا نظرآهاری در گفت و گویی کوتاه با خانواده خود از زندان اوین اعلام کرد تا مدتی از امکان برقراری تماس تلفنی محروم خواهد بود. شیوا نظر آهاری، پس از گذراندن ۳۳ روز در سلول انفرادی بند ۲۰۹، در ۲۶ تیر ماه به سلول‌های عمومی بند مزبور منتقل و در طول این مدت تنها موفق به چند تماس کوتاه با خانواده اش شده‌است. او طی این مکالمات از ارائه درخواست ملاقات با خانواده خود خبر داده که تا به امروز چنین امکانی محقق نشده‌است.

پدر شیوا که یکی از انقلابیون سال ۵۷ بوده‌است، در پی بازداشت وی نامه‌ای سرگشاده منتشر کرده و ضمن ابراز ندامت از انجام انقلاب اسلامی، از بی عدالتی شدید در نظام جمهوری اسلامی گلایه کرده‌است.

در تاریخ ۲۳ مرداد وبگاه کانون زنان ایرانی اعلام کرد که شیوا بیش از ۲۰ روز است که حتی موفق نشده‌است به خانواده خود تلفن کند، و مامورین امنیتی به خانواده او گفته‌اند که وی ممنوع الملاقات است. از اینرو نگرانیهای جدی در زمینه سلامتی ایشان وجود دارد.

در تاریخ ۱۰ شهریور ۱۳۸۸ پس از گذشت بیش از ۸۰ روز از دستگیری شیوا نظرآهاری، قوه قضاییه برای آزادی او درخواست قرار وثیقه بسیار سنگین پانصد میلیون تومانی نمود در حالیکه خانواده شیوا قادر به پرداخت چنین مبلغ هنگفتی نبودند. مادر شیوا به دادگاه انقلاب مراجعه و به قرار مزبور اعتراض نموده‌است اما بازپرس سبحانی (بازپرس پرونده شیوا) ضمن ممانعت از ادامه بحث گفته‌است: «پس بگذارید در زندان بماند.»

در پی مراجعات فراوان خانواده شیوا به دادگاه، در تاریخ ۲۵ شهریور از سوی قوه قضاییه قرار وثیقه وی از ۵۰۰ میلیون تومان به مبلغ ۲۰۰ میلیون تومان کاهش یافت.[۱۵] سپس با پرداخت این مبلغ توسط خانواده وی، شیوا نظر آهاری در ساعت ۲۱ تاریخ یک مهر ۱۳۸۸ به طور موقت از زندان اوین تا زمان تشکیل جلسه دادگاه آزاد شد اما این پایان کار نبود.

پس از درگذشت آیت‌الله منتظری برخی از کسانی که در مراسم ختم وی شرکت کرده بودند بازداشت شده‌اند. اما این بازداشت‌ها حتی اندکی پیش از رسیدن به مراسم ختم این فقیه منتقد و در راه قم انجام شد.

شیوا نظرآهاری یکی از این افراد است.

گفته می‌شود افرادی که همراه این فعال حقوق بشر بودند از جمله کسانی هستند که کمپینی را به نام «عاطفه نبوی»، دانشجوی بازداشت شده در راهپيمايی ۲۵ خرداد به راه انداخته‌اند. این کمپین مدنی تلاش می‌کند تا عاطفه نبوی از زندان آزاد شود.

خانم نظرآهاری پس از آنکه با گذاشتن وثیه از زندان آزاد شد، خاطراتی را ملاقات خود با عاطفه نبوی در زندان اوین منتشر کرد. در این خاطرات، عاطفه نبوی یکی از قربانیان شکنجه جسمی و جنسی معرفی شده است.

نسرین ستوده، حقوقدان درباره بازداشت خانم نظرآهاری، بازجویی از دیگر افرادی که همراه وی عازم قم بودند و موکلش، عاطفه نبوی، می‌گوید:

مطابق اظهارات ديگر افرادی که به همراه خانم نظرآهاری چند ساعتی مورد بازداشت و بازجويی قرار گرفته‌اند، اتهام اصلی که برای خانم نظرآهاری و هومن فخارمقدم (که در آنزمان با قید وثیقه در مرخصی از اوین بسر میبرد) و دوستان ديگری که در آن اتوبوس بودند مطرح شده است اين بوده که چرا آنها مبادرت به ايجاد «کمپين عاطفه نبوی» کرده‌اند. همان طور که می‌دانيد موکل من، خانم عاطفه نبوی، فقط به دليل شرکت در راهپيمايی ۲۵ خرداد به چهار سال حبس تعزيری از سوی شعبه ۱۲ دادگاه انقلاب اسلامی محکوم شده و صراحتاً در حکم صادره عليه عاطفه اعلام شده که او به دليل فعاليت خانواده‌اش به چنين مجازات سنگينی محکوم می‌شود، يعنی مهمترين اصل حقوق کيفری که اصل شخصی‌بودن جرم و مجازات است در اين حکم ناديده گرفته شده است.

به همين دلايل من فکر می کنم خانم نظرآهاری به درستی دست به ايجاد چنين کمپينی زده و از اين بابت هم تحت فشار قرار گرفته است.
